Adventure Collection Limited Practical Lifetime Warranty 

The Warranty

Fox Head, Inc., whose address is 16752 Armstrong Avenue, Irvine, CA, 92606, has built its reputation by engineering products that exceed consumer expectations for quality and durability. The Adventure Collection is backed by a Limited Practical Lifetime Warranty against products that have a manufacturing or material defect. When you purchase a new GORE-TEX product that carries the "GUARANTEED TO KEEP YOU DRY" promise, you, as the original owner, are eligible to a limited commercial guarantee from W. L. Gore & Associates at no additional costs, valid for the useful life of the product and subject to the terms/conditions found here.

Adventure Riding is demanding on both rider and gear—no matter how good it is—it does not last forever. Practical Lifetime is a common sense, judgment call at our discretion in which we take into consideration the intensity of conditions under which the gear is used, plus the ride age of each piece. If after an assessment of your product, we determine your product has exceeded its Practical Lifetime and deem the product ineligible for warranty repair or replacement, we will contact you to discuss available options we may have for you.

Who may use this Warranty? 

This Warranty extends to the original purchaser of the Adventure Collection product warranted under this Warranty during the Warranty Period (each, a “Consumer”). Proof of purchase is required to assert a Warranty claim.

What is covered in this Warranty? 

This Warranty covers all products in the Adventure Collection line that have a manufacturing or material defect. A manufacturing or material defect exists if the product departs from its intended design. Defective materials (zippers, buckles, fabrics, etc.) or defective manufacturing (seams, construction, etc.) are covered by this Warranty for the Practical Lifetime of the product.

How long does this Warranty last? 

The term of this Warranty begins on the date the product is manufactured, as indicated on the manufacturing or date code on the product and continues for the Practical Lifetime of the product (the “Warranty Period”).

What are the Warranty’s Exclusions and Limitations? 

This Warranty does not cover cosmetic damage, damage caused as a result of a crash, damage caused by failing to properly maintain the product, loss, theft, damage as a result of unauthorized repair modification or disassembly, intentional damage, misuse or abuse.

This Warranty does not cover GORE-TEX products that carry the “GUARANTEED TO KEEP YOU DRY” promise in the Adventure Collection as it pertains to waterproofness, windproofness or breathability of the fabric. Because we cannot control the quality of products sold by unauthorized sellers, the Limited Practical Lifetime Warranty covers only products purchased from us or our authorized sellers, unless otherwise prohibited by law. We reserve the right to reject warranty claims for products purchased from unauthorized sellers, including unauthorized internet sites. 

Our responsibility for defective products is limited to repair or replacement as described in this Warranty. We may replace your product with a product of equal of better physical condition.

The remedies described herein are your sole and exclusive remedies and our entire liability for any breach of this Warranty. Our liability shall under no circumstances exceed the actual amount paid by you for the defective product, nor shall we under any circumstances be liable for any consequential, incidental, special or punitive damages or losses, whether direct or indirect, unless otherwise required by law.

Some states and/or countries do not allow the exclusion or limitation of incidental, consequential or other damages, so the above limitation or exclusion may not apply to you.

This limited warranty grants specific legal rights, which are additional to other rights that a specific jurisdiction may grant. This limited commercial warranty is without prejudice to the legal warranty of the product existing in each state or country.

Proof of purchase is required to assert a Warranty claim. All claims must be submitted within the Warranty Period. How do I care for my Fox GORE-TEX products?

All Fox GORE-TEX Products needs simple care to prolong durability. Simply use the GORE-TEX Guide and follow the care instructions on your product to ensure long-lasting performance and extend your product's life cycle.

Why are the GORE-TEX products not guaranteed for a fixed time period?  

The GORE-TEX Team focuses on products useful life rather than any fixed periods of time, as expected useful life can vastly differ depending on the product type and the end use for which it is designed. Any fixed guarantee period, though it may be easier to understand and execute, will not accommodate the wide array of products made with their technologies.

What does useful life of the product mean?  

The length of time a product can reasonably deliver expected performance relative to its intended end use. The expected useful life of a product depends on the type of product and its intended end use. For example, a pair of running gloves should not be expected to last as long as a mountaineering jacket. If you’re caring for your product regularly following the care instructions provided by the GORE-TEX brand and the manufacturer, your product has the potential to perform longer. A product will be considered beyond useful life when it is damaged or worn beyond the possibility of repair or restoration to a fully functional waterproof, windproof and breathable condition. Eventually all products wear out with time and end use.

I’ve damaged my Fox GORE-TEX product. What can I do?

We are happy to look at any GORE-TEX garment that needs repair and evaluate if it can be fixed. Contact one of the authorized repair centers and you will have your garment repaired at a reasonable price.

How do you chose between repair, return or refund?

Our commitment to sustainability means we’ll always explore repair as a first option. If repair is not possible, we’ll replace it with the same or a similar product of equal value. In case we cannot find a replacement product within reasonable time and effort, we will refund your purchase price as long as you have purchased from Fox directly.
